MARRIAGE REGISTRATION - WILL OUR APPLICATION BE ACCEPTED?

So – the engagement party is celebrated, all friends and close relatives are notified. We are getting married! But where do we want to get married? In the registry office, in the church, on the seashore, on the plane above our meeting place? When? The sooner the better? Or we also have a certain date, which is so important to both of us that we simply can't do it on another day and therefore we should at least apply half a year before?
Either way, you have to apply first. What else to remember?

The plot with forgotten (lost, stolen, ...) rings on the wedding day has already been tiresomely played out in films. That it doesn't seem funny at all anymore. But are rings the only thing you might forget when preparing for a wedding?

Ilona (28 years old, married for 18 months):

"Our "list of forgotten things" was started long before the wedding. the first time, excited and a little out of sorts, immediately after deciding to get married we ran to the registry office - so much I wanted to submit the application sooner - and only then it turned out that only Ugis and my manager had the passport with them there were not enough certificates. The second time, when we were finally able to coordinate times and come together to the registry office, it turned out that my passport had expired... So we could only start preparing with the third pass for a specific wedding date. About the rest of the forgotten things, until we got to the point, I'd rather keep quiet... However, we will we took it quite healthy - better small difficulties (eh, what are these difficulties, slightly annoying little things) now, but in the future - everything is nice and smooth. And so it is!”

So – if you have decided to get married in the registry office , then for you, if you both get married first once, it is necessary:

present valid identity documents for both:

  • death certificate of the former spouse;
  • divorce certificate issued by the registry office or a sworn notary;
  • a court judgment by which the marriage was divorced or declared invalid has entered into legal force;
  • extract or certificate from the divorce register or the marriage register with information about the divorce. if both (or one of you) have previously been married to another marriage and the information about the divorce is not included One of the following documents must be presented in the population register;
  • for both to come together to the registry office or the diplomatic or consular office of the Republic of Latvia at the representative office in foreign countries and personally submit a prescribed application signed jointly by both;

If one of you is a minor , the application must be accompanied by the parents, guardians of the minor or written permission of the Orphan's Court.

If it is not possible to obtain a divorce certificate , it can be replaced by a court judgment on establishing the relevant fact.

If you have decided to get married not in the registry office where you submit the application, but in another one, or also to get married to a clergyman , you will be given a statement about the document necessary for concluding the marriage check. This certificate will be valid for six months from the date of issue.

The Civil Law stipulates that a marriage with legal consequences can also be registered in eight denominations - Evangelical Lutheran, Roman Catholics, Orthodox, Old Believers, Methodists, Baptists, Seventh Day Adventists, believers of Moses (Judaists) - the clergy. If you belong to one of the mentioned denominations and want to get married by a clergyman of your denomination, who has permission from the leadership of the denomination, then you will be married according to the rules of the respective denomination.

Any foreigner who has the right to stay in Latvia at the time of the marriage can also get married in Latvia in the Republic. In addition to the application and the identity document, the foreigner must also submit the relevant foreign country a document on family status issued by the competent institution. If a person who has been granted in the Republic of Latvia stateless status, refugee status or alternative status, there are no necessary documents and they are not possible obtain, the relevant documents are replaced by the person's written declaration about his family status.

The state fee for marriage registration is 14 euros. There may be a fee for the solemn ceremony in each registry office different; the size of the fee can also be affected by whether you want to get married in the premises of the institution or in another, on your own in a chosen place.

SUBMISSION ACCEPTED. WHAT HAPPENS NEXT?

ARRANGEMENT ON MARRIAGE REGISTRATION DAY

First, together with the head of the registry office, you agree on the day and time of marriage registration,     notes on your submission. What to do if you want to register your marriage not at the registry office, but at another one, in a long-seen, very romantic or otherwise significant place? At your request, a departmental officer can register marriage in another suitable place, if the persons who want to enter into marriage provide suitable for marriage registration or appropriate circumstances.

FOLLOWED BY MARRIAGE ANNOUNCEMENT

The marriage is announced on the day of receipt of the application, by posting the announcement for one month in the registry office instead of The announcement shall state the date of announcement, as well as the name and surname of the bride and groom. If anyone has objections against the planned marriage registration, these objections must be submitted in writing at the place of announcement within one month. Then objections are either rejected or the case goes to court until the dispute is resolved. The head of the registry office is eligible to shorten the announcement period based on the application submitted by persons who wish to enter into marriage, and documents confirming the reason mentioned in the application.

Those who have been announced have the right to marry no earlier than one month and no later than six months after the application and submission of other documents necessary for the marriage to the registry office, if there is no marriage to be concluded Obstacles / to the conclusion of marriage specified in the Civil Law are:

  • one spouse is a minor, but in exceptional cases with the consent of parents, guardians or the orphans' court in marriage, a person who has reached the age of sixteen, if the marriage is concluded with an adult;
  • prohibited marriage between relatives in the direct line, brothers and sisters and half-brothers and half-sisters, between the same sex persons, between the adopter and the adopted and between the guardian and the ward, before the guardianship is terminated relationships;
  • remarriage of a person already married is prohibited.

In urgent cases, the civil registry office official has the right to shorten the minimum term of one month.

If within six months from the day when it became known that there are no obstacles to the conclusion of the marriage, the marriage has not been concluded, but persons still want to enter into marriage, submit the application and start the announcement again.

MARRIAGE REGISTRATION

The time until the wedding passes quickly - there is so much to do that you want to make the days longer. And then that day has come!

The marriage is registered at the registry office or another place that you have agreed with an official of the registry office, on a specified day in the presence of persons wishing to enter into marriage and two adult witnesses, if they have not become the obstacles to the conclusion of marriage specified in the Civil Law are known. Spouse Civil Registry Officer or above clergymen of the mentioned denominations, if the rules of marriage have been observed.

The official of the registry office asks the bride and groom if they want to get married. If both express this wishes, the official announces that the marriage has been concluded on the basis of this agreement and the law. After marriage an official of the registry office or a clergyman issues a marriage certificate to the spouses.

AND YOU ARE HUSBAND AND WIFE!

Remember that if you change your surname /or add your spouse's surname to your surname/, you must change identity document, as it will have become unusable (and unfit for travel!). It is especially important to take it taken into account if you have immediately decided to go on a honeymoon - if the surname will be changed as a result of marriage, but if you forget to change the documents, you may experience an unpleasant surprise. According to the regulations of the Cabinet of Ministers, 30 days after the previous identity document has become invalid, it is necessary to turn to Citizenship and at the migration affairs office to receive a new identity document.

There is no rush, worries and problems with travel documents, especially in cases where marriage is planned in the church, which already registers the marriage at the registry office some time in advance, and already settles it with the exchange of documents related formalities. Then the journey in the new life /in all senses!/ can begin without delay.
